The Constitution of India provides for the constitution of Tribunals in Part XIV-A, which was inserted into the constitution through 42nd Amendment Act, 1976, which added Article 323A and 323B for constitution of Administrative Tribunals and Tribunals related to other matters respectively. Article 323A constitutionally empowers the parliament to constitute Administrative Tribunals for the adjudication of disputes with respect to recruitment and conditions of service of persons appointed to public services and Civil Posts pertaining to the affairs of the Union or of any Corporation owned or controlled by the Government of India. CAT – Central Administrative Tribunals were constituted by an Act of Parliament The Administrative Tribunals Act in 1985. Working of CAT

CAT is governed by the principles of natural justice; however not bound by the procedure laid down in the Code of Civil Procedure, 1908.  The Central Administrative Tribunal has the same powers as that of a Civil Court in India under the provisions of Code of Civil Procedure, 1908. Any appeal against the orders of a Tribunal is to be preferred before the High Court and not straight away before the Supreme Court. Hon’ble the Apex Court of India, held in the case of Chandra Kumar Case (1997), that the appeal against the orders of a Central Administrative Tribunal may not be made directly in the Supreme Court and a person aggrieved by the order has to firstly approach the concerned High Court. The nature of disputes between a Government Employee and the Central Government may be wide ranging but mostly the matters which are filed before CAT are related to the following issues:
