In 2015, the Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts Act was enacted to establish commercial courts across India. The Act provides for the establishment of commercial courts in each district where the annual value of commercial disputes is over Rs. 1 crores, however, through the amendment Ordinance of 2018, this limit has been reduced to three lakh rupees. The Act also provides for the establishment of commercial divisions in High Courts to hear commercial matters of higher value.

Under the Commercial Courts Act, commercial disputes with a value of Rs. 3 crores or more are required to be filed before the Commercial Court in the respective district. The Commercial Court has the power to decide on all aspects of the dispute, including questions of law and fact.

Appellate Forums under Commercial Courts Act

Appeals from the orders of the Commercial Court lie before the Commercial Appellate Court, which is established in each State High Court. The Commercial Appellate Court has the power to hear appeals against orders passed by the Commercial Court and can confirm, modify, or reverse the decision of the Commercial Court.
